Bronx Man Sentenced to 14 Years in Prison for Using the Internet to Entice a Minor to Engage in Sex

LEV L. DASSIN, the Acting United States Attorney for the Southern District of New York, announced that FRANKIE PEREZ, a/k/a "Bxloveboy22@aol.com," a/k/a "Perez2250X@aol.com," was sentenced today by United States District Judge DENISE L. COTE to 168 months in prison and lifetime supervised release for using the Internet to coerce, persuade, and entice a minor to engage in sexual activity.

According to the criminal Complaint, the Indictment to which PEREZ pleaded guilty, the Government’s sentencing letter in the case, and statements made during the sentencing proceeding:

Beginning in 2005, PEREZ, who was a volunteer at New York City public school P.S. 89 in the Bronx, started sending AOL (America Online) instant messages to a 13-year-old child (“Child- 1”) whom he had met at the school. Between 2005 and March 2008, PEREZ, on numerous occasions, met and engaged in sexual activity with Child-1 after communicating with him via instant message. PEREZ’s conduct included providing Child-1 with alcohol in exchange for sex.

In addition, the defendant admitted at a hearing held in connection with today’s sentencing proceeding that he had molested another child (“Child-2”) while babysitting Child-2 in 2007. Child-2 came forward to report this abuse following the defendant’s guilty plea on December 22, 2008, to the crime against Child-1.

In imposing sentence, Judge COTE stated, “. . . I have to think about adequate punishment for what you have done, adequate individual deterrence so you won't repeat these acts, and adequate protection for society so that no one else will be victimized by the behavior you have engaged in, that there will be no other children who will be abused by you.” Mr. DASSIN praised the investigative work of the Federal Bureau of Investigation and thanked the New York City Police Department, the Bronx District Attorney’s Office, the New York City Department of Education, the New York City Administration for Children’s Services, and the Family Advocacy Program at Jacobi Medical Center, for their assistance in this case.
